SAFE COSMETICS PROGRAM

REGULATORY BACKGROUNG

 

The California Safe Cosmetics Act of 2005 requires cosmetic manufacturers to disclose to the California Department of public Health (CDPH) all products sold in California containing ingredients listed by authoritative scientific bodies cited in the California Health and Safety Code Section 111791.5.

 

UPDATE

 

If the 23 designated lists that comprise the reportable ingredients list is updated, then cosmetic companies have 6 months to comply from the date of adoption or effective date, whichever is later. To assist with reporting online, CDPH has compiled the list of reportable ingredients based on lists and reports available from the scientific bodies. The last update was in December 2023, and the new substances reported were implemented in our system.   

 

SPECIFICITY OF A FRAGRANCE INGREDIENT

 

Isoeugenol (CAS # 97-54-1) was already on the California SB 312 Reportable Ingredients List as a fragrance allergen. As a fragrance allergen, it only needed to be reported previously if it was present in a rinse-off cosmetic product at a concentration at or above 0.01% (100 parts per million), or in a leave-on cosmetic product at a concentration at or above 0.001% (10 parts per million).  

Now, Isoeugenol is listed as an IARC-classified 2B carcinogen and  recognized on the Reportable Ingredients List as a carcinogen. It will be subject to disclosure under SB 312 regardless of concentration within the next 6 months.

 

WHAT ABOUT EXTENDED FRAGRANCE ALLERGENS ?

 

The reportable ingredients list is being updated to include the newly listed fragrance allergens (in accordance with requirements provided in regulation (EC) 2023/1545), pursuant to the Cosmetic Fragrance and Flavor Ingredient Right to Know Act (SB 312). Fragrance allergen ingredients have a distinct reporting requirement from other reportable ingredients under this law. Fragrance allergens must be reported when present in a rinse-off cosmetic product at a concentration at or above 0.01% (100 parts per million), or in a leave-on cosmetic product at a concentration at or above 0.001% (10 parts per million). According to the current timelines, the deadline to report the new allergens is June 2024. 

We are working in collaboration with our ingredient suppliers to obtain all the relevant and necessary information on the new fragrance allergens, and we will complete our data analysis and implementation in a timely manner in line with the transitional arrangements.

The goal of the California Safe Cosmetics Program is to collect and share information on hazardous and potentially hazardous ingredients in cosmetics sold in California and to make this information available to the public.

A Year of Success and Growth

 

I am delighted to share with our followers  our achievements in 2023 and our strategy for 2024.

We achieved a record sales of over 90 million euros in 2023, which is a substantial  organic  increase of 12% compared to 2022. This is the result of the hard work of the teams, innovation and customer satisfaction.

Europe has been extremely successful due to strong increases in the natural / organic market and high sales in France , Belgium and South Europe especially Italy and Greece. We expanded our international presence with the strengthening of our perfumery  laboratory in Dubai to better cover our customers in Middle East , created  a subsidiary in Algeria, implemented  new management and  organization in our branches in the UK and the USA and increased Sozio presence  in the emerging markets in Africa. We have also  consolidated our structure in South Europe with the implantation of Sozio Iberica in Valencia.

Our business in Asia is solid and fast growing with our headquarter based in Hong Kong , two factories in China and Indonesia, and  commercial branches in Vietnam and Philippines. We diversified our business and expertise with the full integration of Synarome, a leading producer of fragrance ingredients and specialties, and the development of our natural formulation expertise. We increased our production capacities with the opening of a new factory in China, which is now fully operational, and the doubling of our production capacity in France with a new Robot. All of our laboratories worldwide have been revamped to be state of the art .They are equipped with the latest technology and tools , such as robots, digital devices and olfactive cabins , they allow us to create ,test and  produce fragrances faster, more efficiently and more reliably.

We have participated in various professional fairs such as In-Cosmetics , Beautyworld , Simmpar , NCA , ISSA and Cosmetica Algeria , revamped our website, undertaken various actions in perfume schools, developped more  innovative collections anticipating new trends , and aimed for a greater digitalization. We are developing  our CSR policy and implementing  various actions to respect the environment and support the social development in the countries where we operate. But the most important is that we  maintained our artisanal spirit and customer proximity, which are our core values. We always strive to offer personalized and tailor-made solutions to our clients, and  share  our passion for fragrances to enhance the well –being of consumers.

Our teams can be very proud of what we have achieved in 2023.

 

Our strategy for 2024

 

We have a clear and ambitious strategy for 2024, which is based on five pillars: innovation, internationalization, diversification , digitilization and responsibility.

We aim to pursue our growth, by targeting a turnover of more than 100 million euros , reinforcing the pillars of our strategy of the last 5 years. We intend to reinforce our presence in Asia, especially in China, where we plan to open a sales office in Shangai and in India and Latin America  where we plan to create  subsidiaries. We continue the development of our new technologies , specially our Malodor neutralizers Absorbzio , our low VOC Reed Diffuser base and our scented air freshener gels. We promote digitalization in all processes of our business including Perfume Creation, Evaluation , Sales&Marketing , Production, Regulatory and Customer Service. We commit to respect the highest environmental and social standards, by using natural and sustainable ingredients, by reducing our carbon footprint and by supporting solidarity projects. We are very confident in our ability to achieve these goals, thanks to our vision, our creativity and our reactivity, keeping in mind our artisanal spirit and the proximity to our customers. We are very grateful   to our clients, partners and employees for their trust and support. We look forward to continuing this journey with you in 2024 and beyond.

AGREEMENT ON THE CLP REVISION ABOUT “MORE THAN ONE CONSTITUENT SUBSTANCES” (MOCS) CLASSIFICATION

REGULATORY BACKGROUNG

 

On 30 June 2023, the Council finalized its position on the proposed CLP regulation, focusing on the classification of “More than One Constituent Substances” (MOCS) including essential oils.

The proposed CLP regulation introduced a definition for multi-constituent substances and stated that their classification should follow the same rules as mixtures when data on individual constituents is available unless specific provisions in Annex I to CLP exist.

This means, if an individual constituent of the MOCS was classified as CMR (Carcinogenic, Mutagenic, or Toxic to reproduction), and/or ED (Endocrine Disruptor), this classification would apply to the multi-constituent substance as a whole, even if data showed the absence or less severe properties for the substance.

 

COSMETICS EUROPE AND IFRA HAVE EXPRESSED CONCERNS ABOUT THE PROPOSED APPROACH 

Maintaining the classification rules as they currently stand within CLP for these natural substances was critical to avoid the over classification of a number of natural substances, with a cascading effect on their continued use and authorization in cosmetic products.

IFRA and Cosmetics Europe engaged a trilogue discussion with institutions and work with stakeholders to discuss the particularities of the essential oils sector in the new policy environment, and the regulatory conditions for a sustainable and competitive fragrance sector.

 

 

 

 

 

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION REACHED AN AGREEMENT FOR THE CLASSIFACTION OF MOCS 

The Member States’ Permanent Representatives Committee acknowledged the complexity and difficulties arising from the shift of approach proposed by the European Commission for the classification of MOCS.

Member States finally opted to maintain the current approach, introducing a review clause for the European Commission to report to the European Parliament and Council on the applicable articles regarding the classification of MOCS four years following the entry into force of the revised CLP regulation. This decision allows for MOCS to be classified based on all relevant available scientific data, whether it’s on their individual constituents, or on the whole substance.

The CLP agreement ensures to avoid the avoidance of over classification of a number of natural substances.

Cosmetics Europe and the International Fragrance Association (IFRA) welcome this decision as it is in line with the EU’s own ambitions to boost the bio- and circular economies.

“We highly appreciate the recognition by the co-legislators of the need for specific provisions for the classification rules of substances with more than one constituent (‘MOCS’) extracted from plants or plant parts. This is a key development to support the future of the natural ingredients used in cosmetics and fragrances, which goes hand in hand with the EU’s objective to boost the bioeconomy”, said John Chave, Director General, Cosmetics Europe.

 

TO CONCLUDE

The CLP revision is the first completed building block of the EU Chemicals Strategy for Sustainability (CSS). The CSS will be complemented by other important milestones for the fragrance industry, such as the revision of REACH and review of the Cosmetics Products Regulation.
